Welcome to SecurePass. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and SecurePass ("we", "us", or "our"), concerning your access to and use of the SecurePass application, website, and related services (collectively, the "Service").
BY DOWNLOADING, ACCESSING, OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
1. Description of Service and "Best Effort" Provision
SecurePass is provided as a free, local-first, privacy-focused password manager. We offer this application on a "best-effort" basis. Since the Service is provided free of charge, we do not guarantee uptime, continuous availability, bug-free operation, or future updates. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability.
2. Your Data, Your Absolute Responsibility
SecurePass operates on a strict zero-trust, local-first architecture. This fundamental design means:
- No Centralized Storage: Your data, including but not limited to credentials, notes, and payment cards, is encrypted and stored strictly locally on your devices, unless you explicitly opt to use your own third-party cloud storage (e.g., Google Drive) for syncing.
- No Key Escrow: We do not possess, store, transmit, or have the ability to access your Master Password or the cryptographic keys used to secure your vault.
- No Recovery Mechanism: If you forget or misplace your Master Password, your data is irrevocably lost. We cannot and will not recover, reset, or bypass your credentials under any circumstances.
- Data Backups: You bear the sole responsibility for maintaining adequate, secure, and up-to-date backups of your encrypted vault. We are not responsible for any data loss, corruption, or hardware failure that might compromise your local data.
3. Assumption of Risk
You acknowledge and agree that your use of the Service is entirely at your own risk. While SecurePass uses industry-standard encryption practices, no software is entirely immune to vulnerabilities, exploits, or device-level compromises (such as malware, keyloggers, or rooted/jailbroken environments). The responsibility for maintaining the overall security of the device running SecurePass falls entirely on you.
4. Acceptable Use
You agree that you will not:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to compromise the integrity or security of the Service.
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Service (except where specifically permitted by open-source licenses, if applicable).
- Use the Service to transmit malware, spyware, or malicious code.
5. Intellectual Property
The Service, excluding user-generated or user-stored data, but including its original code, designs, features, and functionality, are owned by SecurePass and are protected by applicable intellectual property and copyright laws.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SECUREPASS EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will function uninterrupted, secure, or available at any particular time or location.
- Any errors or defects will be corrected.
- The Service is free of viruses or other harmful components.
- The results of using the Service will meet your specific requirements.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SECUREPASS, ITS DEVELOPERS, MAINTAINERS, AFFILIATES, AGENTS, DIRECTORS, OR EMPLOYEES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
Under no circumstances will SecurePass be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Service or your account or the information contained therein. Because this is a free tool provided on a best-effort basis, our total liability to you for any claims arising out of or related to the Service is strictly limited to nothing ($0.00).
8. Indemnification
You agree to defend, indemnify, and hold harmless SecurePass and its developers and maintainers from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your use of and access to the Service.
- Your violation of any term of these Terms of Service.
- Your violation of any third-party right, including without limitation any privacy or intellectual property right.
- Any claim that your use of the Service caused damage to a third party.
9. Modifications to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. It is your responsibility to review these Terms periodically. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
10. Governing Law
These Terms shall be governed and construed in accordance with standard international software distribution norms, without regard to conflict of law provisions. Any failure on our part to enforce any right or provision of these Terms will not be considered a waiver of those rights.
